These Terms and Conditions of Sale (TCS) define the terms and conditions applicable to the use of services provided by Evasioning, a brand of the iEVASION agency, located in Agadir, Morocco. By booking a service with our agency, you agree to these terms.
1. Purpose
These TCS aim to define the rights and obligations of the parties in the context of the sale of travel services, excursions, tours, and events offered by Evasioning.
2. Reservations and Payments
2.1 Reservation Process
All service reservations must be made via our website, by phone, or in person at our agency. Once the reservation is confirmed, you will receive a confirmation email detailing the reserved services and payment conditions.
2.2 Payment Terms
Payment for services can be made by credit card, bank transfer, or any other payment method accepted by the agency. A deposit of 50% of the total amount may be required at the time of booking, with the balance payable before the start of services, according to the terms specified in the confirmation.
2.3 Non-Payment
In the event of non-payment by the agreed due date, the agency reserves the right to cancel the reservation. The cancellation fees described in Article 4 below will then apply.
3. Prices
The prices of services are indicated in MAD, EURO, and USD and include applicable taxes unless otherwise stated. Prices may be changed at any time, but services will be billed based on the rates in effect at the time of reservation confirmation.
4. Cancellation and Modification
4.1 Cancellation by the Client
Any cancellation request must be made in writing (email or letter) and is subject to the following fees:
- Cancellation more than [X] days before departure: [X]% of the total service amount.
- Cancellation between [X] and [Y] days before departure: [Y]% of the total service amount.
- Cancellation less than [Y] days before departure or no-show: [Z]% of the total service amount.
4.2 Reservation Modification
Any modification of a reservation is subject to service availability and may incur additional fees. Evasioning will do its best to accommodate your modification requests.
4.3 Cancellation by the Agency
If Evasioning is unable to provide the reserved services due to reasons beyond its control (force majeure, etc.), we will offer you an equivalent alternative or a full refund of the amounts paid.
5. Liability
5.1 Agency Liability
Evasioning commits to providing services in accordance with the descriptions on our website and in our communications. However, the agency cannot be held responsible for program modifications due to unforeseen circumstances, such as unfavorable weather conditions, strikes, or other situations beyond our control.
5.2 Client Responsibility
The client is responsible for verifying the validity of necessary travel documents (passports, visas, vaccinations, etc.) and complying with the laws and regulations of the countries visited. Evasioning cannot be held responsible in case of entry refusal or expulsion of the client by local authorities.
6. Insurance
It is strongly recommended to take out travel insurance covering risks such as cancellation, accident, illness, and repatriation. Evasioning can offer you suitable insurance upon request.
7. Complaints
Any complaint regarding our services must be submitted in writing within 30 days after the end of the trip. Evasioning commits to handling complaints promptly and finding an amicable solution.
8. Applicable Law and Jurisdiction
These TCS are governed by Moroccan law. In the event of a dispute, and after attempting to reach an amicable resolution, the competent courts of Agadir will have exclusive jurisdiction to settle the matter.
